Terms and Conditions

Effective Date: May 22, 2026

These Terms govern the use of services offered by Drivars through website, dashboard, support channels, and related booking flows. By using the platform, you agree to these Terms, our Privacy Policy, and applicable service-specific conditions.
Regulatory and Compliance Framework

Our operations are designed to align with applicable Indian laws and regulatory requirements, including:

  • Motor Vehicles Act, 1988 and applicable central/state transport rules.
  • Information Technology Act, 2000 for electronic records and digital transactions.
  • Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020 for fair marketplace and grievance handling.
  • Digital Personal Data Protection Act, 2023 and related rules, as applicable to digital personal data processing.
  • Applicable tax, invoicing, anti-fraud, and record-keeping obligations under Indian law.
Customer Terms

By creating an account, submitting booking requests, using Driver Hub, or making payments, customers accept the following terms:

1. Account and Eligibility
  • You must provide accurate name, mobile number, and other details required for booking and support.
  • You are responsible for account security, including OTP/PIN confidentiality and device-level security.
  • Account misuse, identity impersonation, or fraudulent activity may lead to suspension without prior notice.
2. Booking and Service Use
  • Service availability depends on location, category, timing, and driver assignment status.
  • Bookings may include one-way, round-trip, outstation, airport, permanent, business, and related mobility services.
  • You must provide correct pickup/drop details, timing, and operational instructions to avoid service disruption.
3. Pricing, Taxes, and Payments
  • Fare estimates are indicative until final booking confirmation and may vary by timing, route, waiting, tolls, parking, or package rules.
  • Applicable charges, taxes, and statutory components are shown on invoice/booking summary where applicable.
  • Failed, reversed, or disputed payments can result in pending status, temporary hold, or booking cancellation.
4. Cancellation, Refund, and No-Show
  • Cancellation and refund eligibility depends on service type, assignment progress, and notice window.
  • No-show, delayed reporting, or incorrect location details may attract partial/complete charges as per policy.
  • Approved refunds are processed through original payment mode or lawful alternative process within reasonable timelines.
5. Conduct and Safety
  • Customers must treat drivers and support staff respectfully and avoid abusive, unlawful, or unsafe conduct.
  • Alcohol/drug abuse, harassment, violence, illegal transport requests, or policy breaches are strictly prohibited.
  • Safety incidents must be reported via official support channels with booking/ticket reference.
6. Driver Hub and Subscription
  • Driver Hub access and profile visibility may be governed by active subscription plan limits and duration.
  • Subscription benefits are non-transferable and may change based on published plan terms.
  • Unauthorized scraping, copying, or commercial exploitation of profile data is prohibited.
7. Data Privacy and Communication
  • You consent to transactional communication (SMS, call, email, or in-app) for bookings, OTP, support, and compliance notifications.
  • Personal data is processed in accordance with applicable privacy laws and the platform privacy policy.
  • Users must not share sensitive credentials with unauthorized persons.
Driver Terms

By registering or operating as a driver partner on Drivars, you agree to the following obligations and conditions:

1. Onboarding and Verification
  • You must submit true, valid, and current documents, including license and identity as required by law and platform policy.
  • Approval may require compliance checks, profile review, and additional verification requests.
  • Submission of forged, expired, or misleading documents may result in immediate rejection/blacklisting.
2. Legal and Operational Compliance
  • Drivers must comply with all transport, road safety, and local authority regulations applicable to assigned service categories.
  • You are responsible for lawful conduct while on duty, including adherence to route, timing, and passenger safety norms.
  • Any legal non-compliance, unsafe driving, intoxication, or criminal misconduct may lead to suspension and legal escalation.
3. Service Standards
  • Maintain punctuality, professional communication, and service quality as expected by platform standards.
  • Do not demand unauthorized charges outside approved booking/assignment terms.
  • Trip status, completion updates, and issue reporting must be done honestly and promptly.
4. Earnings, Deductions, and Payout
  • Payouts are based on completed and validated trips/inquiries as per operational records.
  • Chargebacks, disputes, penalties, compliance deductions, or tax adjustments may be applied where contractually or legally required.
  • Fraudulent trip activity, collusion, or duplicate claims may result in payout hold or forfeiture.
5. Account Security and Acceptable Use
  • Driver account credentials, OTP, and PIN must be kept confidential.
  • Account sharing, unauthorized substitution, or delegated usage without approval is prohibited.
  • System misuse, data theft, or platform manipulation can trigger permanent access removal.
6. Status of Engagement
  • Unless specifically agreed in writing, driver onboarding through the platform does not by itself create employer-employee relationship.
  • Each driver remains responsible for statutory compliance applicable to their own operations and earnings, as required by law.
General Legal Terms (Applicable to All Users)
A. Suspension and Termination

We may suspend, restrict, or terminate access for policy violations, fraud risk, legal non-compliance, abuse, non-payment, or safety concerns.

B. Limitation of Liability

To the extent permitted by applicable law, platform liability is limited to direct losses attributable to proven service failure and excludes indirect, consequential, or speculative losses.

C. Indemnity

Users agree to indemnify and hold harmless Drivars, its team, and affiliates from losses arising out of misuse, misrepresentation, illegal acts, or breach of these Terms.

D. Dispute Resolution and Governing Law

These Terms are governed by the laws of India. Parties should first attempt good-faith resolution through support channels. If unresolved, disputes are subject to competent courts having jurisdiction under applicable law.

E. Updates to Terms

We may update these Terms for regulatory, operational, or policy reasons. Continued use after updates constitutes acceptance of the revised Terms.
